Lianhuan App User Agreement
[Preamble and Introduction]
Our company (hereinafter referred to as "Lianhuan App") hereby specially reminds users to carefully read and fully understand this Service Agreement (hereinafter referred to as the "Agreement"). Users should carefully read and fully understand each clause in this Agreement, including the disclaimer clauses that exempt or limit the liability of Lianhuan App and the clauses that restrict users' rights. Please read prudently and choose to accept or not accept this Agreement (minors should read this Agreement accompanied by their legal guardians). Unless you accept all the terms of this Agreement, you have no right to register, log in, or use the related services involved in this Agreement. Your registration, login, use, and other behaviors will be deemed as acceptance of this Agreement and consent to be bound by its various terms.
This Agreement is an agreement between you (hereinafter referred to as "User") and Lianhuan App regarding user registration, login, and use of the "Lianhuan App" services. This Agreement describes the rights and obligations between Lianhuan App and users regarding the "Lianhuan App" services. "User" refers to individuals or organizations that register, log in, use, and browse this service. Your acceptance of this Agreement means you are bound by all terms, including accepting any modifications made by Lianhuan App to any service terms at any time. This Agreement may be updated by Lianhuan App at any time. Once published, the updated terms will replace the original terms without further notice. Users can check the latest version of the Agreement in this App. After Lianhuan App modifies the terms of the Agreement, if the user does not accept the modified terms, they should immediately stop using the services provided by Lianhuan App. Continued use of the services provided by Lianhuan App will be deemed as acceptance of the modified Agreement.
1. Rules of Use
Users fully understand and agree that this platform is only provided for users to share, transmit, and obtain information. Users must be responsible for all behaviors under their registered accounts, including but not limited to any content transmitted by you and any consequences arising therefrom.
Any content transmitted by users in or through the service does not reflect the views or policies of Lianhuan App, and Lianhuan App shall not bear any responsibility for this.
Users fully understand and agree that this is a social information browsing product based on user relationship networks. Users must bear full responsibility for the authenticity, legality, and validity of the registration information on the platform. Users must not impersonate others; must not use the name of others to disseminate any information; must not maliciously use registered accounts to cause misunderstanding by other users; otherwise, Lianhuan App has the right to immediately stop providing services, reclaim the account, and the user shall bear all legal responsibilities arising therefrom independently.
Users shall be fully responsible for the authenticity, legality, harmlessness, and validity of the information transmitted on the platform. Any legal responsibilities related to the information disseminated by users shall be borne by the users themselves and have nothing to do with Lianhuan App.
Lianhuan App reserves the right to unilaterally change, suspend, restrict, terminate, or revoke all or part of the service content at any time without any notice due to business development needs. Users shall bear this risk.
The services provided may include advertisements. Users agree to display advertisements provided by third-party suppliers and partners during use.
Users shall not use the service to create, upload, copy, or send the following content:
(1) Content that opposes the basic principles established by the Constitution;
(2) Content that violates the Cybersecurity Law and other relevant regulations;
(3) Content that endangers national security, leaks state secrets, subverts state power, or undermines national unity;
(4) Content that damages national honor and interests;
(5) Content that incites ethnic hatred or discrimination and undermines ethnic unity;
(6) Content that undermines national religious policies or promotes cults and feudal superstitions;
(7) Content that spreads rumors, disrupts social order, or undermines social stability;
(8) Content that disseminates obscenity, pornography, gambling, violence, murder, terror, or instigates crime;
(9) Content that insults or defames others and infringes upon the legitimate rights and interests of others;
(10) Information containing other content prohibited by laws and administrative regulations.
Lianhuan App may, at its reasonable discretion, stop transmitting any content that violates relevant laws, regulations, or this Agreement; infringes upon, obstructs, or threatens the rights or safety of any person; or involves impersonation. Lianhuan App has the right to take appropriate legal actions against any person violating this clause at its own discretion, including but not limited to deleting illegal, infringing, or inappropriate content from the service, terminating the membership of violators, preventing them from using all or part of the service, and preserving relevant information and reporting to relevant departments in accordance with laws and regulations.
User Rights and Obligations:
(1) The ownership of Lianhuan App accounts belongs to Lianhuan App. After completing the registration procedures, users obtain the right to use the account. This right to use belongs only to the initial applicant and is prohibited from being gifted, borrowed, rented, transferred, or sold. Due to operational needs, Lianhuan App has the right to reclaim user accounts and has the right to use users' photos, videos, voices, etc. for product promotional activities.
(2) Users have the right to change or delete their personal profiles, registration information, and transmitted content on Lianhuan App. However, please note that deleting relevant information will also delete any text and images you have stored in the system. Users shall bear this risk.
(3) Users are responsible for properly keeping their registered account information and password secure and shall bear legal responsibility for behaviors under the registered account and password. Users agree not to use the accounts or passwords of other members under any circumstances. If you suspect that others are using your account or password, you agree to notify Lianhuan App immediately.
(4) Users shall comply with all terms of this Agreement and use this service correctly and appropriately. If a user violates any terms of this Agreement, Lianhuan App has the right to terminate services to the violating user's Lianhuan App account based on the Agreement. Meanwhile, Lianhuan App reserves the right to reclaim Lianhuan App accounts and usernames at any time.
(5) If a user has a commonly used English account, they have the priority right to register that English account as their account. However, if the user does not register an account within a certain period after the service goes online, or although they have registered a WeChat account, they do not use that English account as their WeChat account, it will be deemed that the user has waived the right to register that English account as a WeChat account. Lianhuan App has the right to reclaim that English account and assign it to other users to avoid resource waste. Any problems arising therefrom shall be borne by the user.
(6) If a user does not log in to the account for a long time after registration, Lianhuan App has the right to reclaim the account to avoid resource waste. Any problems arising therefrom shall be borne by the user.
(7) If a dispute occurs, users can use the reporting function to safeguard their platform rights. Upon receiving a user report, the reported user is obligated to actively inform or cooperate with customer service to verify the situation. If the reported content is verified to be true, Lianhuan App has the right to restrict the user's illegal behaviors through warnings, limiting account functions, etc. For serious violations, Lianhuan App has the right to directly freeze the account, and the balance in the account will not be refunded. If a frozen account needs to appeal, the user can contact the official customer service WeChat (zaiyiqiks).
2. Privacy Protection
Users agree that personal privacy information refers to information that can identify the user personally or involves personal communication, including the following information: user's real name, mobile phone number, WeChat account, QQ account, and IP address. Non-personal privacy information refers to basic record information objectively reflected on the Lianhuan App server regarding the user's operation status and usage habits of this service, as well as other ordinary information outside the scope of personal privacy information; and the above privacy information that the user agrees to make public.
Respecting the privacy of users' personal privacy information is a consistent policy of Lianhuan App. Lianhuan App will take reasonable measures to protect users' personal privacy information. Except for requirements by laws or government departments authorized by law, or with the user's consent, Lianhuan App will not disclose or reveal users' personal privacy information to third parties other than cooperative units without the user's consent.
However, this does not apply if the user chooses to agree during registration, or if there are other agreements between the user, Lianhuan App, and cooperative units regarding the disclosure or use of the user's personal privacy information. The user shall bear any risks that may arise therefrom, and Lianhuan App shall not be responsible for this. Meanwhile, in order to operate and improve Lianhuan App's technology and services, Lianhuan App may collect and use or provide non-personal privacy information of users to third parties, which will help Lianhuan App provide better user experience and improve service quality.
Lianhuan App collects data based on users' interactions with Lianhuan App and users' choices, including users' privacy settings and the products and functions users use. The data collected by Lianhuan App may include SDK/API/JS code versions, IP addresses, platforms, timestamps, application identifiers, application versions, application distribution channels, unique device identifiers, iOS Advertising Identifier (IDFA), Android Advertiser ID, MAC address, International Mobile Equipment Identity (IMEI), device models, terminal manufacturers, terminal device operating system versions, session start/stop times, language location, time zones, and network status (WiFi, etc.), hard disk, CPU, and battery usage, etc. This will help Limite conduct internal data analysis and research, third-party SDK statistical services, and improve Lianhuan App's products or services.
To ensure the authenticity of user identity and provide better security protection, users need to submit identity information or biometric information such as facial features (all of which belong to personal sensitive information) to complete the real-person authentication required or necessary for specific product services. The above information will only be used to verify the authenticity of the user's identity.
The above information provided by users will be continuously authorized for use by Lianhuan App during the user's use of this service. When the user cancels the account, Lianhuan App will stop using the above information.
The above information will be stored within the territory of the People's Republic of China. If cross-border transmission is required, Lianhuan App will obtain the user's authorization and consent separately.
App user authenticity authentication requires users to provide some materials that can prove the authenticity of the user's identity. The relevant materials are only used for platform review and will not be disclosed to any other users or used for commercial purposes, except when required by law or relevant departments to intervene.
3. Lianhuan App Trademark Information
Logos, graphics, texts, or their compositions involved in Lianhuan App services, as well as other Lianhuan App logos and product/service names, are trademarks of Lianhuan App (hereinafter referred to as "Lianhuan App Marks"). Without the prior written consent of Lianhuan App, users shall not display, use, or otherwise process Lianhuan App Marks in any way, nor shall they indicate to others that they have the right to display, use, or otherwise process Lianhuan App Marks.
4. Legal Liability and Disclaimer
If a user violates this Agreement or relevant service terms, causing any claims, demands, or losses asserted by any third party, including reasonable attorney's fees, the user agrees to indemnify and hold harmless Lianhuan App and its cooperative companies and affiliated companies.
Lianhuan App and cooperative units shall not be responsible for any losses suffered by users due to third parties such as communication line failures of telecommunications departments, technical problems, networks, computer failures, system instability, and other force majeure reasons.
If the normal operation of the service is affected by force majeure events such as technical failures, Lianhuan App and cooperative units promise to cooperate with relevant units as soon as possible and handle repairs in a timely manner, but Lianhuan App and cooperative units shall not be responsible for any losses suffered by users therefore.
Like most Internet services, this service may be affected by differences in factors including but not limited to user reasons, network service quality, and social environment, and may be disturbed by various security issues, such as others using users' data to cause harassment in real life; other software downloaded and installed by users or other websites visited contain viruses such as "Trojan horses," threatening the security of users' computer information and data, thereby affecting the normal use of this service, etc. Users should strengthen their awareness of information security and user data protection, pay attention to strengthening password protection to avoid losses and harassment.
Users must understand that because this service involves Internet services, it may be affected by unstable factors at various links. Therefore, there is a risk of service interruption or failure to meet user requirements caused by force majeure, computer viruses or hacker attacks, system instability, user location, user shutdown, and any other technical, Internet, or communication line reasons. Users shall bear the above risks, and Lianhuan App makes no guarantees. Lianhuan App shall not bear any responsibility for users' inability to send and receive or read messages, or send and receive wrong messages caused thereby.
Users must understand that there is a risk of anonymous or misnamed information from any person during the use of this service, including threatening, defamatory, offensive, or illegal content or behaviors, or infringement of others' rights (including intellectual property rights). Users shall bear the above risks. Lianhuan App and cooperative companies make no warranties of any kind for this service, whether express or implied, including all implied warranties and conditions of merchantability, fitness for a particular purpose, ownership, and non-infringement regarding information authenticity, and shall not bear any responsibility for any direct, indirect, incidental, special, and consequential damages arising from users' improper or illegal use of the service.
The information content defined by Lianhuan App includes: text, software, sound, photos, videos, charts; all content in advertisements; commercial information provided by Lianhuan App to users. All these contents are protected by copyright, trademark rights, and other intellectual property and ownership laws. Therefore, users can only use these contents under the authorization of Lianhuan App and advertisers, and cannot copy, modify, compile these contents without authorization, or create derivative products related to the contents.
Under no circumstances shall Lianhuan App be liable for any indirect, consequential, punitive, incidental, special, or penal damages, including loss of profits suffered by users due to the use of the service (even if informed of the possibility of such losses). Notwithstanding any contrary provisions in this Agreement, Lianhuan App's total liability to you, for any reason or in any manner, shall never exceed the fees you have paid to Lianhuan App for using the service during the membership period (if any).
5. Membership Terms
Lianhuan App members equally enjoy membership rights and shall comply with Lianhuan App's various norms and rules, including but not limited to these service terms and the "User Agreement."
Any losses related to the suspension of membership services due to violations of Lianhuan App's "User Agreement" shall be borne by the user.
Members can enjoy various value-added services of Lianhuan App membership during the valid period of membership qualification.
If a member actively terminates or cancels the membership qualification during the valid period of membership qualification, Lianhuan App is not responsible for refunding the service fees corresponding to the remaining valid period of the membership qualification.
Members shall bear legal responsibility for transmitting and publishing information in Lianhuan App and using Lianhuan App's free or paid services. Members' use of Lianhuan App services, including free and paid services, shall comply with various laws, regulations, rules, and normative documents.
After membership services are activated, they cannot be transferred or unsubscribed.
If a member violates laws and regulations while using Lianhuan App's free or paid services, Lianhuan App has the right to cancel the member's membership qualification without any compensation, and the member shall bear full responsibility.
6. Miscellaneous
Lianhuan App solemnly reminds users to pay attention to the clauses in this Agreement that exempt Lianhuan App from liability and increase users' obligations. Please read carefully and consider the risks independently. Minors should read this Agreement accompanied by their legal guardians. The final right of interpretation and modification of the above terms belongs to Lianhuan App.
If any part or all of the terms stipulated in this Agreement are invalid, it shall not affect the validity of other terms.
The interpretation, validity, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China. If any dispute or controversy arises between the user and Lianhuan App, it should first be resolved through friendly negotiation. If negotiation fails, the user hereby fully agrees to submit the dispute or controversy to the jurisdiction of the People's Court at the domicile of Lianhuan App.
The copyright of this Agreement belongs to Lianhuan App, and Lianhuan App reserves all rights of interpretation and modification.
